Right of Withdrawal
Platform version covering four application cases. This English version is the authoritative and legally binding version.
Overview
The applicable withdrawal policy depends on what you bought and from whom. The relevant case is shown in the listing, during checkout and in the order confirmation.
- Case A — Purchase of a Credit pack from the Operator (VOD Auctions). 14-day withdrawal for consumers.
- Case B — Purchase from Frank Bull / VOD Records (Operator as commercial Seller). 14-day withdrawal for consumers.
- Case C — Purchase from a third-party commercial Seller or small business (§ 19 UStG). 14-day withdrawal addressed to that Seller.
- Case D — Purchase from a private Seller (C2C). No statutory right of withdrawal. A notice is displayed before checkout.
Note on auctions
Online auctions on this Platform are notgenerally treated as "publicly accessible auctions" under § 312g (2) No. 10 BGB pending explicit legal confirmation. The right of withdrawal therefore applies in Cases B and C also to auction purchases.
Case A — Credit pack purchase
You have the right to withdraw from the purchase of a Credit pack within 14 days without giving reasons. The period starts on the day the contract is concluded.

On withdrawal we refund the payment for any unused Credits without undue delay and at the latest within 14 days from receipt of your declaration, using the same payment method, free of fees.
Early expiry of the right. The right of withdrawal expires for Credits already used where you have expressly consented to immediate use and confirmed that you lose the right of withdrawal with respect to consumed Credits. These confirmations are collected explicitly at purchase; unused Credits remain refundable within the 14-day period.
Case B — Purchase from Frank Bull / VOD Records
You have the right to withdraw within 14 days without giving reasons. The period starts on the day on which you, or a third party other than the carrier, have taken possession of the goods; for partial deliveries, on the day of the last partial delivery.

You may use the attached model withdrawal form, but this is not obligatory. To meet the withdrawal deadline, it is sufficient that you send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
On withdrawal we refund all payments received including delivery costs (excluding extra costs from a more expensive shipping option you selected) without undue delay and at the latest within 14 days from receipt of your declaration, using the same payment method, free of fees.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back.
You must return the goods without undue delay and in any case within 14 days from notifying the withdrawal. You bear the direct cost of return shipping. You are only liable for any diminished value resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
Case C — Purchase from a third-party commercial Seller or small business
The right of withdrawal applies as in Case B, with the difference that the addressee of the withdrawal declaration is the respective third-party Seller. The Seller's address, email and where applicable phone number are shown in the listing, in the order confirmation, and on the public Seller profile.
The Platform supports you technically in submitting the declaration to the Seller; reimbursement is processed by the Seller, not by the Platform.
Reduced warranty period for used goods. For used goods, a commercial Seller may shorten the warranty limitation period to no less than one year (§ 476(2) BGB). Such shortening is effective only where you were informed of it before submitting the order and it was expressly and separately agreed; it does not cover claims for damages. Listings to which this applies show the notice clearly.
Case D — Purchase from a private Seller (C2C)
No statutory right of withdrawal. When you buy from a private Seller, the contract is between you and a private individual. There is no consumer-goods purchase within the meaning of § 312 BGB; the special consumer-protection rules for distance contracts between trader and consumer — including the 14-day right of withdrawal — do not apply.
The private Seller may exclude liability for defects ("Sold under exclusion of any liability for defects") where this is clearly and individually agreed before purchase; the exclusion does not cover intent, fraudulently concealed defects, assumed guarantees, or personal-injury liability.
Before checkout the notice "Private sale. Consumer rights for purchases from traders do not apply; in particular there is no statutory right of withdrawal." is shown clearly.

Exceptions to the right of withdrawal
The right of withdrawal does not apply or expires early, among other cases:
- for contracts for the delivery of sealed goods which are not suitable for return due to health protection or hygiene reasons, if their seal has been removed after delivery;
- for contracts for the delivery of sound or video recordings or computer software in sealed packaging, where the seal has been removed after delivery;
- for contracts for the delivery of goods manufactured to customer specification or clearly personalised;
- for Credits already used after your express consent and confirmation of loss of the right (Case A).
